Eligibility
You must be at least 18 years of age to use the Website. By using the Website and by agreeing to this Agreement, you warrant and represent that you are at least 18 years of age. To become a tutor or a freelancer, users must first apply to become a tutor through the link
Become a Tutor. Peachtree Educational Counseling Services, LLC reserves the right to approve or deny any tutor application at its sole discretion.
Tutoring and Freelancing Services
Tutor DB is a platform that facilitates the connection between clients and independent contractors (tutors/freelancers) who provide tutoring and freelancing services. Peachtree Educational Counseling Services, LLC does not directly provide any tutoring or freelancing services and is not responsible for the quality of service provided by tutors/freelancers. The online one-to-one tutoring sessions are facilitated through our free e-learning tools wihtout any warranty of any kind. It is possible that establishing connections and performing the handshaking steps can take a short amount of time. This usually does not take more than a few seconds and it's out of our control. As a result, until the session and the related services are fully launched a few seconds will be passed. Please note that the timer starts counting the session duration as soon as the session is started (ie, right before the aforementioned signaling and handshaking process starts). Please note also that at any point of time during a session, you can pause the timer. Please also note that pausing and resuming sessions may also take up to around 1-2 seconds to become effective, depending on your internet speed.
Restrictions on use of services
Tutors are not allowed to solve graded exams/quizzes/homework questions that are not due yet at the time of the session. Neither are they allowed to complete or otherwise help in completing coding projects that will be graded in any way (e.g., school projects, coding assignments, interview questions, etc.).
Referral
While we do encourage tutors and mentees to refer prospective students/tutors to our platform, we advise complying with any applicable terms of services if you got to know the referred user on other platforms.
Payment and Refunds
Before clients can start a freelancing or tutoring session, they need to purchase Tutor DB Credits to use on our platform. Credits can be purchased with credit or debit cards. A 2.99% convenience fee is due upon purchase of credits. This fee is charged by our 3rd party payment processor, not us and is not refundable. The unused credits are refundable upon request only within the first 90 days of purchase. This does not include the non-refundable fees charges for services that have already been used (e.g., the payment processing fee). Clients can use their purchased credits to pay for services they receive from tutors/freelancers or to create Featured Requests.
Fees and Promotions
Our fees, promotions, and bonus points are subject to change and will depend on multiple factors, including the costs and revenue of our platform. We will always consider users of our platform as our priority and will obviously consider their satisfaction when adjusting the fees.
Refunds
Under certain conditions as stipulated by our terms, clients may be eligible for a refund of the service they have received from tutors/freelancers. This can be in the form of a courtesy credit per Tutor DB's discretion or due to a dispute that has been resolved in favor of the client. In order to be able to dispute a session, the student needs to submit his request before the payment for the session is released to the tutor/freelancer. Currently, each session remains in a pending state for 72 hours. Once the payment is released there is no way to dispute the session.
Disclaimer
The Website is provided "as is," with all faults, and Peachtree Educational Counseling Services, LLC makes no express or implied representations or warranties, of any kind related to the Website or the materials contained on the Website. Additionally, nothing contained on the Website shall be construed as providing consultation or advice to you.
Limitations of liability
In no event shall Peachtree Educational Counseling Services, LLC, nor any of its officers, directors and employees, be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract. Peachtree Educational Counseling Services, LLC, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.
Indemnification
You agree to indemnify, defend and hold harmless Peachtree Educational Counseling Services, LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Website, including, but not limited to, Peachtree Educational Counseling Services, LLC's Content, User Content, and any use of the Website's resources.
Severability
If any provision of these Terms of Service is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms of Service unenforceable or invalid as a whole. Any such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or court decisions.
Assignment
These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Peachtree Educational Counseling Services, LLC without restriction.
Entire Agreement
These Terms of Service, together with the Privacy Policy and any additional terms to which you agree when using particular elements of the Website, constitute the entire agreement between you and Peachtree Educational Counseling Services, LLC with respect to the use of the Website, and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Peachtree Educational Counseling Services, LLC.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the state of Georgia, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the state courts located in Georgia and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
By using the Website, you represent that you have read and understood these Terms of Service and agree to be bound by all of its provisions. If you do not agree to these Terms of Service, you should not use the Website.
